Oran hesaplamas\u0131nda yar\u0131ma kadar olan kesirler dikkate al\u0131nmazken. Yar\u0131m ve daha fazla olan kesirler yukar\u0131ya yuvarlanarak istihdam\u0131 zorunlu engelli \u00e7al\u0131\u015fan say\u0131s\u0131 tespit edilmektedir.<\/p><p>K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015fanlar \u00e7al\u0131\u015fma s\u00fcreleri dikkate al\u0131narak tam s\u00fcreli \u00e7al\u0131\u015fmaya d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr ve i\u015fyerindeki tam s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131na ilave edilmelidir.<\/p><p>Engelli personel \u00e7al\u0131\u015ft\u0131rma gereklili\u011fine ili\u015fkin hesaplama yap\u0131l\u0131rken ilgili \u015firketin SGK i\u015fyerlerindeki \u00e7al\u0131\u015fan say\u0131lar\u0131 ve bu SGK i\u015fyerlerinin bulundu\u011fu idari il s\u0131n\u0131rlar\u0131 esas al\u0131n\u0131r.<\/p><p>Zorunlu \u00e7al\u0131\u015ft\u0131r\u0131lacak engelli personel say\u0131s\u0131n\u0131n tespitinde belirli veya belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015ft\u0131r\u0131lan t\u00fcm i\u015f\u00e7iler esas al\u0131nacakt\u0131r.<\/p><p>Engellilerin \u00f6zel sekt\u00f6r i\u015fyerlerinde tam s\u00fcreli olarak \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 esast\u0131r. Ancak, engellilerin talebi halinde, i\u015fyerlerinde k\u0131smi s\u00fcreli k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle de istihdamlar\u0131 da m\u00fcmk\u00fcnd\u00fcr. Ancak i\u015fverenin istihdam zorunlulu\u011fu yine k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerinin tam s\u00fcreli \u00e7al\u0131\u015fmaya d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi ile tespit edilecektir.<\/p><p>\u00d6zel sekt\u00f6r i\u015fvereninin, engelli a\u00e7\u0131\u011f\u0131 do\u011fduktan 30 g\u00fcn sonra a\u00e7\u0131\u011f\u0131n\u0131 kapatmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p><p>1. \u00d6zel sekt\u00f6r i\u015fverenleri, \u00e7al\u0131\u015ft\u0131rmakla y\u00fck\u00fcml\u00fc bulunduklar\u0131 i\u015f\u00e7ileri, y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn do\u011fmas\u0131ndan itibaren be\u015f i\u015f g\u00fcn\u00fc i\u00e7inde niteliklerini de belirterek \u0130\u015eKUR&#8217;dan talep eder.<\/p><p>2. \u0130\u015eKUR, \u00f6zel sekt\u00f6r i\u015fvereninin engelli talep tarihinden itibaren en ge\u00e7 on g\u00fcn i\u00e7inde, ba\u015fvuranlardan nitelikleri uygun engellileri, durumlar\u0131n\u0131 ve niteliklerini belirten belgelerle birlikte i\u015fverenle g\u00f6r\u00fc\u015ft\u00fcr\u00fcr.<\/p><p>3. \u0130\u015fveren bu g\u00f6r\u00fc\u015fmeden itibaren engelli a\u00e7\u0131\u011f\u0131n\u0131, en ge\u00e7 on be\u015f g\u00fcn i\u00e7inde, \u0130\u015eKUR taraf\u0131ndan g\u00f6r\u00fc\u015ft\u00fcr\u00fclenler ya da \u0130\u015eKUR portal\u0131nda kay\u0131tl\u0131 di\u011fer engelli i\u015f arayanlar aras\u0131ndan bizzat se\u00e7erek veya kendi imk\u00e2nlar\u0131yla temin edece\u011fi engelliler aras\u0131ndan kar\u015f\u0131lar. \u0130\u015fe al\u0131nanlar\u0131 ve al\u0131nmayanlar\u0131, al\u0131nmay\u0131\u015f nedenlerini de belirterek \u0130\u015eKUR&#8217;a bildirir.<\/p><p>\u0130\u015fverenler g\u00f6r\u00fc\u015fmeyi takip eden 15 g\u00fcnl\u00fck de\u011ferlendirme s\u00fcresi sonunda sonu\u00e7lar\u0131 bildirerek a\u00e7\u0131\u011f\u0131n\u0131 kapatmamas\u0131 halinde, takip eden iki i\u015fg\u00fcn\u00fc i\u00e7erisinde i\u015fverenler iadeli taahh\u00fctl\u00fc posta yoluyla yaz\u0131l\u0131 olarak uyar\u0131l\u0131r ve tebli\u011f tarihinden itibaren be\u015f i\u015f g\u00fcn\u00fc i\u00e7erisinde talebini sonu\u00e7land\u0131rarak a\u00e7\u0131\u011f\u0131n\u0131 kapatmas\u0131 istenir.<\/p><p>Buna ra\u011fmen de y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmeyen i\u015fverenlere 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 101 inci maddesine istinaden \u00e7al\u0131\u015ft\u0131rmad\u0131\u011f\u0131 her engelli ve \u00e7al\u0131\u015ft\u0131rmad\u0131\u011f\u0131 her ay i\u00e7in Kurum il m\u00fcd\u00fcr\u00fcnce idari para cezas\u0131 uygulan\u0131r.<\/p><p>Ayr\u0131ca, engelli i\u015f\u00e7i a\u00e7\u0131\u011f\u0131n\u0131 kapatmamakta \u0131srar eden i\u015fverenlere kontenjan a\u00e7\u0131\u011f\u0131n\u0131 kapat\u0131ncaya kadar idari para cezas\u0131 uygulanmaya devam edilir.<\/p><p>4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 101. maddesinde engelli \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fc\u011f\u00fcne uyulmamas\u0131 durumunda verilecek idari para cezas\u0131 d\u00fczenlenmi\u015ftir.
